1. Who we are

Inner Beat ("the Service") is provided by katherine ("we", "us", "our"). By accessing, registering for, or using the Service you ("you", "user") enter into a binding agreement with katherine on these terms.

2. Acceptance

By continuing to use the Service you agree to these Terms. If you do not agree, do not use the Service. You confirm that you are of legal age in your jurisdiction or have authority to bind the organisation on whose behalf you use the Service.

3. The Service

Inner Beat is a minimalist canvas for recording fitness check-ins, mood notes, photos, and related media. Features and pricing tiers are described on our pricing page.

4. Accounts

You are responsible for keeping your credentials confidential and for all activity under your account. You agree to provide accurate information and to keep it up to date.

5. Acceptable use

You must not misuse the Service. In particular you must not:

  • use the Service for unlawful, fraudulent, or harmful purposes;
  • upload content that infringes intellectual property, privacy, or other rights;
  • upload spam, malware, or other malicious content;
  • probe, scan, scrape, or attempt to bypass security or rate limits;
  • resell, sublicense, or redistribute the Service without our written consent;
  • reverse engineer or attempt to extract the source code, except where permitted by law.

6. User content

You retain ownership of the content you upload. You grant katherine a limited, worldwide, royalty-free licence to host, store, transmit, and display your content solely for the purpose of operating and providing the Service to you.

7. Intellectual property

The Service, including its software, design, branding, and documentation, is owned by katherine and protected by applicable laws. We grant you a limited, non-exclusive, non-transferable right to use the Service within your chosen plan.

8. Payments, billing and subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, taxes, currency, renewal, cancellation, and refund mechanics are governed by the Paddle Checkout Buyer Terms. Subscription plans renew automatically until cancelled. See our Refund Policy for the refund window.

9. Service availability

We work hard to keep the Service running, but we do not guarantee that it will be uninterrupted, error-free, secure, or available at all times. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

10. Suspension and termination

We may suspend or terminate your access to the Service if you materially breach these Terms, fail to pay applicable fees, create security or fraud risk, or repeatedly or seriously violate our policies. You may stop using the Service at any time.

On termination your right to use the Service ends. We may delete your content after a reasonable retention period; you are responsible for exporting any content you wish to keep.

11. Liability

To the fullest extent permitted by law, katherine is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill. Our aggregate liability for any claim relating to the Service is limited to the fees you paid us in the 12 months before the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded by law (such as for fraud, death, or personal injury caused by negligence).

12. Indemnity

You agree to indemnify katherine against claims arising out of your content, your unlawful use of the Service, or your breach of these Terms.

13. Changes

We may update these Terms from time to time. Material changes will be communicated through the Service. Continued use after the changes take effect constitutes acceptance.

14. Governing law

These Terms are governed by the laws of katherine's place of residence, and disputes are subject to the exclusive jurisdiction of its competent courts, except where mandatory local consumer law provides otherwise.
